Ben Collins QC, Eleena Misra, Nadia Motraghi and Rachel Owusu-Agyei are instructed on behalf of IWGB, by Leigh Day, in a challenge to the Job Retention Scheme and extended Statutory Sick Pay regime in the context of the COVID-19 pandemic and the position of precarious workers including those in the gig economy.
The Claimants assert that the exclusion of limb b workers, the application of the existing SSP rate and the Lower Earnings Limit are unlawful and in certain respects discriminatory and in breach of ECHR rights. The Claimants also assert that the Government has failed to comply with its Public Sector Equality Duty. The Administrative Court will consider the matter at a rolled-up hearing on 11th June 2020 before Lord Justice Bean and the Hon Mr Justice Cavanagh.
