The case concerned a Christian nurse who was dismissed for improper proselytising at work. She brought proceedings for unfair dismissal and also claimed that there had been a breach of her right to religious expression under article 9 of the European Convention of Human Rights. Cyril acted for the Trust at all stages. The case has attracted considerable media interest and comment. In unanimously dismissing the appeal, the Court of Appeal examined the limits of proselytising in the workplace and held that the distinction between proper and improper proselytising, which had been applied by the EAT in a number of cases, was correct and in line with ECHR jurisprudence.
The appeal was televised and can be viewed here.
