Adam Samuel has secured the dismissal of a Claimant’s claim on grounds of fundamental dishonesty in the case of Faizan v Pakeeza Dairies Limited.
The Claimant suffered injury during the course of his employment with the Defendant in 2014. A number of years post-accident, he continued to allege significant accident-related symptoms and advanced, amongst other things, allegations that he would suffer ongoing future inability to work and associated loss of earnings.
Following a 2-day trial and extensive cross-examination of the Claimant, despite a finding that the Claimant had genuinely suffered a very modest injury (the quantum of which being assessed at £1,500), the court was satisfied that the claim was tainted by “fundamental dishonesty” such that the entirety of his claim was dismissed, with leave to enforce costs in full.
