Supreme Court hands down brain injury judgment

Yesterday the Supreme Court handed down judgment on the case of Woodland v Essex, in which a woman won a landmark ruling over a brain injury she suffered in a pool as a primary school student.
 
David Wilby QC, who was instructed on Chittock v Woodbridge School [2002] EWCA Civ 915, [2003] PIQR P6, commented on the case in today's Times.
 
"I think there is a great danger that what we will get is an over-reaction to this decision. It is really intended to give clarity to the law rather than introduce a completely new legal regime.
 
"School governors who are less well advised may think they cannot now sanction a school trip to the Alps, or whatever, when that is not what this decision is really about"
