The Supreme Court have handed down Judgment today, allowing Mr Knauer’s appeal and overturning Cookson v Knowles [1976] AC 556.
The multiplier by which future losses are to be calculated in Fatal Accident Act claims will now be determined at the date of trial rather than the date of death.
As a result Claimant’s will no longer suffer the injustice of having their claim discounted as though they had received early payment of damages.
