Since the judgment in For Women Scotland v Scottish Ministers, dealing with the meaning of ‘sex’ in the Equality Act 2010, was handed down in April 2025 a narrative has appeared that trans people should be excluded from facilities which must be arranged in a single-sex basis.
Robin Moira White examines this narrative from a trans-inclusive basis and how that may constitute unlawful discrimination against trans people. She also questions whether For Women Scotland is good law.
