Powell v Brent London Borough Council

Court of Appeal

Principles governing granting an injunction in employment contracts.
No injunction would be granted that required an employer to let a worker continue in his job when the employer had sought to terminate that employment or to prevent the worker carrying out his work unless there was clear evidence that it was just to make such a requirement and there also existed sufficient confidence on the part of the employer in the servant's ability or other attributes to make the order. Sufficiency of confidence had to be justified by reference to the circumstances of the case including the nature of the work, the people with whom it would be done and the likely effect on the employer and the worker if the injunction was granted.
