The Public and Commercial Services Union, representing approximately 185,000 UK civil service workers, has been granted permission by the High Court to pursue a judicial review challenging the minimum service levels required during strikes by workers in Border Security.
PCS argues that those minimum service levels are unlawful by reference to Article 11 of the European Convention on Human Rights (ECHR), which safeguards the right to freedom of association, including the right to form and join trade unions and take industrial action.
