Occupational stress claims – practice notes by Liam Ryan on LexisNexis

Liam Ryan has written a practice note on Occupational stress, in partnership with LexisNexis.

The note has two sections, one on ‘liability and foreseeability’, and one on ‘breach, causation and apportionment’.

The law in this area has developed unevenly, shaped by a sequence of judgments that have each refined what employers are taken to know, and what they are taken to be able to do about it.

The notes return to first principles: what foreseeability actually requires on the facts of a given case, how causation is approached where vulnerability and workplace conditions are intertwined, and where the real evidential battlegrounds tend to lie at trial.
