Claim against school in negligence where a pupil ran out into the road and was struck by a passing car.

Claim by a schoolgirl suing by her mother as next friend in respect of alleged negligence on the part of her school teachers in permitting her to run out from the school into the path of a passing car. HELD: No school could ensure that accidents would never happen, especially when a child broke the rules as the plaintiff had done here. The fact that there had only been one similar incident in the past six years was evidence that all proper and reasonable steps to ensure the children's safety had been taken. Claim dismissed.
