Since 1980’s Old Square Chambers  has been centre stage in defining the contours of collective labour law. In 2016, it continues to be influential in this area, with members instructed in a number of high profile trade disputes, including advising the BMA in the junior doctors’ strike action, as well as appearing in numerous reported cases: SofS v NUT [2016] IRLR 512 and GTR v ASLEF [2016] IRLR 686 (John Hendy QC leading Stuart Brittenden in both); and United Voices of the World [2016] IRLR 695 (Giles Powell).

In November, Old Square features in two of the most significant cases in  the Court of Appeal concerning trade union recognition: PDAU v Boots Management Services Ltd (John Hendy QC and Simon Cheetham for PDAU), and BALPA v Jet2.com (Stuart Brittenden for BALPA, Ben Cooper for Jet2 (both as junior counsel)). In January 2017 the Supreme Court will consider how to calculate pay for days lost through strike action in Hartley v King Edward VI College (Oliver Segal QC and Katharine Newton for the union, Ben Cooper for the College).

Our seminar, will be chaired by John Hendy QC who has appeared in most of the UK's leading cases in this area over the last 36 years and who is recognised as being ‘… supreme in the field of collective labour law’ (Legal 500).

The session will cover the following areas:

  • Trade Union recognition (and incorporation of terms)
  • The Trade Union Act 2016
  • Industrial action – recent significant cases
