This session explores recent updates and topical trends in industrial relations and how these may chart the future direction of labour law. The speakers will cover the following themes:
- Inducements relating to collective bargaining s. 145B of the Trade Union and Labour Relations (Consolidation) Act 1992 in light of Dunkley & Ors v Kostal UK Ltd – to be heard by the Supreme Court on 18 May 2021.
- Whether s. 146 of the 1992 Act protects workers from detriment for participating in industrial action during working hours? A consideration of Article 11 ECHR; Mercer v Alternative Future Group Ltd (to be heard by the EAT on 6 May 2021); Morais & Ors v Ryanair DAC;
- Judicial attitudes to compliance with the “labyrinthine code” governing industrial action under Part V of the 1992 Act; Ryanair DAC v BALPA [2020] IRLR 698.
The session also touches upon future trends, including the potential implications of the decline in presenteeism on industrial relations, the growth of union activism in new areas, such as tech, and the increased focus on certain issues such as health and safety and social issues.
