Employment Tribunal finds that Wetherspoons failed to make reasonable adjustments for autistic employee

News, Employment & discrimination

In Mr Halstead v J D Wetherspoons (Case no: 1400644/2024), the ET found that the Respondent failed to make reasonable adjustments in relation to the Claimant, who has autism. Following a minor breach of the employee discount policy, for which the Claimant apologised once he was made aware, the Respondent decided to pursue a formal disciplinary investigation for gross misconduct.

The Respondent was ordered to pay the Claimant £25,412 in relation to the successful complaint of failure to make reasonable adjustments.

The case was widely reported on in the national media, including in The Independent, The Telegraph, and the Daily Mail.

You can read the liability judgment and reasons here and the remedy judgment can be found here.

Annie Davis acted for the Claimant, Brandon Halstead, and was instructed by Jo Martin of Bellevue Law. Both Annie and Bellevue acted pro bono.
