Old Square counsel, Oliver Segal QC and Stuart Brittenden, instructed by Thompsons on behalf of UNITE, are to appear in the Supreme Court in ground-breaking £420,000 ‘unlawful inducement’ case, Kostal. The employer bypassed the trade union during collective bargaining, making direct offers to its unionised workforce as individuals under the threat of losing a Christmas bonus if they did not accept. This is widely regarded as the most significant case to reach the Supreme Court in the field of collective labour law since Wilson/Palmer.
