From 15 November, those who have paid fees at an Employment Tribunal or Employment Appeals Tribunal between 29 July 2013 and 26 July 2017 are able to apply for a refund following the Supreme Court’s decision in R (UNISON) v Lord Chancellor [2017] UKSC 51. The court held that the fees regime for bringing and continuing claims in those tribunals was unlawful under domestic and EU law, as it effectively prevented access to justice.
