After a failed JSM and the trial of the four lead claims in the Achticlor litigation, Torbay NHS trust has been forced to pay substantial compensation to a significant number of its employees who suffered moderate symptoms of irritation when using this cleaning product on a regular basis in their hospitals. The JSM failed as the Defendant was unwilling to offer the Lead Claimants sufficient compensation for the problems they suffered; having taken those four cases to trial, and secured indemnity costs in one of the four cases, the other claims have now finally settled. David Rivers acted as counsel for all the Claimants throughout this dispute on both liability and, once this was admitted, quantum.
David Rivers was instructed by Thompsons solicitors.
